In the Kherson region, a young woman was brutally gang-raped. Two criminals were sentenced to nine and four and a half years in prison, but then one of them escaped, and the other was acquitted and released

Giving one's wife over to friends or guests for sexual pleasure was once upon a time customary only among the Chukchi reindeer herders and Australian aborigines. It is simply unthinkable to imagine such savagery now, in the 21st century, in Ukraine. Especially when you consider that her husband gave his 28-year-old wife, mother of two children, to his cronies for reprisal simply because... he owed them money.

This terrible incident occurred two years ago in the village of Belaya Krinitsa, Kherson region.

— In 2015, I lived with my parents in the village of Velikaya Alexandrovka, raising two sons on my own - Vlad and Kolya, - tells FACTS victim Svetlana Yanina. — I often went to the neighboring village of Belaya Krinitsa - my cousin lives there. On one of these visits I met Slava Chernodonsky(name and surname have been changed. - Auto.). We started dating and soon decided to move in together. I knew that Slava used to drink, but his relationship with me changed him. He stopped drinking alcohol and started making good money. True, sometimes he continued to communicate with former friends. Of course, I didn’t like it; quarrels would break out between us.

On that day, which is still hard for me to remember, three of Slava’s friends came to visit us. These were Sergey Akimchuk, Sasha Kurdin(surnames have been changed. - Auto.) And 17-year-old Artur Nesterenko(this accused is wanted, so we indicate his real name and surname. - Auto.). They were slightly drunk, but on the whole they behaved adequately. We ate, played cards, and when a bottle of vodka appeared on the table, I asked the guests to leave - I had no use for drinking at home.

The reaction of my common-law husband amazed me. Slava turned around and... went to bed, leaving me alone with his drunken friends. I went out into the corridor to close the door behind them, and then, quite unexpectedly, the eldest of them, Sergei, turned around and hit me in the face with his fist. I fell to the floor, losing consciousness for a second. Sergei and Arthur grabbed me by the arms and legs, dragged me into the room and threw me face down on the sofa. Arthur held my hands tightly, and Sergei raped me. Then they changed. Meanwhile, the third of the friends, Sasha, lowered his pants and sat on a chair, waiting for his turn. I screamed and called for help from my husband and his mother, who were in the house. No one came.

- How did you manage to escape? After all, three brutal men could simply maim you to death.

“Arthur’s grandmother heard my screams from the street - she was walking around the village, looking for her grandson. Finding our door locked, she knocked on the window. My rapists got scared and ran out of the house (all this is in the case materials). I lay on the sofa for another ten minutes, and then I took the rope and went into the yard to hang myself. My husband “accidentally” woke me up and took me out of the noose. Sobbing, I told him what had happened, asking why he didn’t come to help. At first Slava denied it, saying he was asleep and didn’t hear anything. But then he admitted: he understood what was happening, but was afraid to intervene.

- Horrible!

- In fact, it’s even worse: it turns out that Slava sold me to his friends. At the trial, I found out that my common-law husband repeatedly borrowed money from Sergei and borrowed alcohol from him. Slava also asked Arthur’s grandmother for a large sum—three thousand hryvnia. Arthur admitted to the judge that Sergei, in his presence, asked Slava how he was going to pay. To which my ex-husband replied: “My wife will pay for me.” I compared these statements with the facts and realized that this was true. When I was being raped, Slava was in the next room. He wasn't dead drunk or so tired that he couldn't hear my screams. After all, Arthur’s grandmother heard them from the street. Another proof of his guilt is the door locked from the inside. We never locked it before when we were at home. Well, the main question is: why did he leave me alone with his drunken friends? The answer is obvious: everything the rapists did, they did with the consent of my husband. And, of course, Slava’s reaction is indicative: having learned that his friends had brutally raped me, he did not rush to find them and punish them, as any normal man would do, but told me: “It’s my own fault.”

Svetlana called the police. Half an hour later, fourteen people arrived at the scene - two task forces and criminal investigation officers.

— We found brown traces similar to blood at the entrance to the house,- said the head of the investigation department of the Berislavsky regional police department of the Main Directorate of the National Police in the Kherson region Alexey Suzovetsky. — The bed in the room was rumpled, with traces of blood. The victim herself was also in a deplorable state, beaten, with a bloody face.

All three suspects were detained that evening. After giving her testimony, Svetlana was taken for a forensic examination. The woman’s injuries were terrible: in addition to bruises and bruises on her face, contusions, abrasions and hematomas on the genitals, ruptures in the perineum and fissures in the anus. The police opened criminal proceedings on the fact of group violence in a natural and unnatural manner. Different preventive measures were chosen for the accomplices. Arthur, who fully admitted his guilt, cooperated with the investigation and testified against Sergei, was released under house arrest. Sergei, who, as it turned out, had previously been convicted four times for theft and robbery and refused to make contact with the investigation, was left in custody. The third of the accomplices unexpectedly turned out to be not a suspect, but a witness.

“He won’t go to jail anyway. You didn’t take the money, others will.”

— A suspect can be made a witness if he himself changes his mind about committing a crime, - commented on the situation famous lawyer Aminat Suleymanova. — That is, if Alexander, watching the rape of Svetlana, said: “Something we guys are doing wrong. Let’s stop,” after which he went home; of course, there was nothing to suspect him of. But since the man was sitting with his pants down, waiting for his turn to rape the victim, but he was simply prevented from committing the crime, this man, of course, had to be involved in the case as an accomplice.

— I filed a claim for compensation for moral damages, says Svetlana. — The court satisfied him only half: instead of the hundred thousand hryvnia that I asked, Arthur was ordered to pay me 15 thousand, and Sergei - 35 thousand. Arthur gave the money, but Sergei never admitted his guilt. He said right in the courtroom that when he gets out, he will boil me and eat me. He also did not compensate me for moral damages, although his relatives came to me and, in the presence of my lawyer, offered 70 thousand so that I would withdraw the application. But I didn’t take a penny, because the rapist should be in prison. And compensation for moral damage should be legal, and not in the form of a payoff. Sergei’s sister’s husband told me: “He won’t go to prison anyway. You didn’t take the money, others will.” It turns out that he was right.

True, not to Velikaya Alexandrovka, where he was already considered, but to Berislav.

At the stage of the new trial, when Sergei Akimchuk was no longer in custody, but under house arrest, the host of the “Ukraine Speaks” program on the “Ukraine” TV channel, Alexey Sukhanov, managed to communicate with this man by phone. Here are excerpts from the conversation:

“Are you one of those who participated in the gang rape?» — asked Alexey Sukhanov.

-What rape? — he answered, grinning. - Nobody raped anyone. We just came to get drunk. I know that girl, Sveta. How can someone like that be raped? She gets drunk and offers herself to everyone. So she came at me that day, and I pushed her away so that she wouldn’t bother me.

— Did they hit you? — Sukhanov clarifies.

- Hit or pushed - I don’t remember. And then we left. Let him not invent anything about violence. We didn't have any sex at all.

“I have in my hands an appeal statement written by your lawyer,” says Alexey Sukhanov. — Your lawyer asks the court not to find you innocent, but to reclassify the case from rape in an unnatural way to rape in a natural way. In fact, he admits your guilt.

- Yes, I already agreed to this article. Still a shorter period...

- If you claim that you are innocent, we are ready to test you with a lie detector. If the polygraph confirms the veracity of your words, this may be evidence in court in your favor. We won't show your face.

- I won’t go through anything. To be shamed? Let Svetka pass by. But I have no use for it."

Svetlana underwent a polygraph examination. The lie detector showed that the woman was telling the truth.

“If my rapists are walking free, how can I be calm for the life and health of my loved ones?”

And recently something completely incomprehensible happened. The Berislavsky District Court considered that there was insufficient evidence of Sergei’s guilt, acquitted him and released him.

- I'm really scared“, admitted Svetlana. — I have two children, a mother and father, a 91-year-old grandmother, and a disabled grandfather. If my rapists are walking free, how can I be calm about the life and health of my loved ones? Or should we now hide for the rest of our lives?

Despite the litigation, there is now a bright streak in Svetlana Yanina’s life. She has a loved one. Courageous, strong and kind, he literally and figuratively carries Sveta in his arms. The story of their acquaintance is so interesting that it is worth describing it separately.

— That day I came from Velikaya Alexandrovka to Kherson for a court hearing, recalls Svetlana. — I had a return ticket for the evening, but while I was getting to the station, I was robbed - they snatched my bag with all my documents, money, and phone. I stood on the street and cried. I didn’t understand what to do, where to run. A tall, strong man came up to me and asked: “Why are you crying? Can I help you?"

— When I saw the crying girl, I couldn’t pass by, - tells FACTS Dmitry Sapiga. — She said she was robbed. At first, a doubt crept into my mind: is this not a scam? But Sveta did not ask for money, but, on the contrary, began to call the police. I believed her and decided to help. I went to the box office and bought a ticket. I waited until she returned from the district department and took her to the train. But when she left, my soul became restless. I didn’t know whether Sveta got home or how she felt after her experience. I cursed myself for not getting her home phone number. I was so exhausted that I decided to find this girl at all costs.

Dmitry found the train crew and clarified at which station Svetlana got off (the conductor remembered a thin, upset girl - she got off alone at that stop). Then he began calling police departments, district administrations and village councils, trying to find contacts of Svetlana Yanina (he remembered her last name when he bought the ticket). The officials gave the persistent guy information very reluctantly: why on earth would he, not a brother, not a husband, suddenly become so interested in a girl he barely knew?

“I couldn’t explain it to myself.”, - Dmitry admits. — I only knew that I couldn’t do it any other way. Only after four days of intense searching did I finally manage to find Sveta’s address. I went to see her, but didn’t find her at home - she was at a friend’s birthday party. I left my business card, not even expecting her to call. But Sveta called and then came to me. It was then, when I saw her for the second time, that I realized that I would never let her go again.

- Dima, I can’t help but ask. You have decided to throw in your lot not with an ordinary girl, but with a woman who has suffered severe physical and mental trauma. Did you understand that you and her would need to go not to cafes and cinemas, but to the courts?

- That's what he does, - Svetlana is responsible for Dmitry. — From the time I told him everything, he has always been with me, supporting and protecting me in everything. True, it costs me a lot of work to keep him from lynching. It was especially difficult when Sergei was released...

- The only thing I wanted then wascut off this bastard's dignity and cripple him the same way he crippled Sveta,- Dmitry cannot contain his anger. — But she begged me not to do this. Because this will only add problems to the family. And we already have enough difficulties...

After Sveta was raped, doctors diagnosed her with infertility. She cried a lot - she and Dmitry wanted a child together, a girl. When the lovers realized that this was impossible, they began to think about taking the baby from the shelter.

- God helped me survive this whole nightmare,- says Svetlana. — I started going to church and praying. I confessed and took communion. My confessor advised me to forgive the offenders. I try not to hold a grudge against them and pray more. And you know, the Lord heard my prayers. Two months ago a miracle happened: contrary to doctors’ predictions, I became pregnant! Dima and I are going to get married soon. God willing, we will give birth to a healthy baby. And I will forever forget all this horror. Yes, of course, I would like the rapists to be convicted according to the law, and I even filed an appeal against the acquittal. But even if human judgment leaves them unpunished, I know that they will not escape God’s judgment.

I was very tired and hungry. My little Vika also began to be capricious and began to cry. We went home.

The next day, continuing to look for Misha, I went to the construction site.

On the site, there was a trailer and some kind of boards, logs, bricks lay around. Suddenly a man came out of the trailer, followed by a woman.

The man turned around, it was Misha, and with him was some kind of woman, and it was immediately clear that she was not her sister.

I threw a huge scandal, expressed everything I thought about him and demanded the money back for my apartment.

He yelled at me to get out of his own area, but he was not going to return the money and that she would never prove that she had ever given him money.

I filed a lawsuit for fraud. Well, my father helps and hired lawyers and took my daughter and me to live with him, otherwise we were left with the baby on the street.

I am a small businessman myself, trying to feed my family, I manage to earn something. Even that spring, I decided to please my husband and buy him a newer car so that he wouldn’t drive a junk one.

He works as a security guard, the cat has cried for his salary. That's why I decided to make a gift. Before the purchase, we agreed: you sell your old car for 100 thousand rubles, and return this money to me. Moreover, he chose a car for 500 thousand rubles, despite the fact that I only allocated 400 thousand.

I set a time frame: for him to do it within a month. Can you? “Yes,” he said he would do it. It was necessary to slightly repair the old car, which was running, paint it and start selling it. He even warned that he would take time off from work and would spend a month preparing and selling the car.

But in the end, everything was somehow forgotten, swirling in the bustle. I remembered after 4-5 months, and was interested in how the sale of the car was actually going. As it turned out, he didn’t even do it. Some excuses that one of my friends promised to buy, but is holding out. And nothing concrete... So another month passed. Again I ask: “So how?” In response I hear only rudeness: “Well, it started up again, get out of here.” And whenever he tries to start a conversation, he gets angry, gets angry and is rude.

And then I thought: “But this is a real scam.” As an entrepreneur, I understand that the other party to the contract did not fulfill the agreement, and is not even going to explain anything to me, and it seems that they will not return this money. This is what people call “scammer”.

I have had such cases in my business, I even got sick because of this, and my husband furiously condemned those who did not fulfill the terms of the contract. In those cases, I had to resort to both pressure and the involvement of mutual acquaintances, and I always achieved a return.

But in this case we are talking about a loved one. Why he does this I don't understand.

And then I remembered, but it’s always been like this. He talked about some “ways to earn extra money”, I gave him money, even took out a loan, and in the end everything was washed away and forgotten, and he never managed to earn extra money and increase his money. He harshly suppressed and was rude to any attempts to find out when the “profit” would be. I must say that I did not shirk my work. But I’ve already accepted that he can’t make money. It’s as if he has a block: earn no more than 30 thousand rubles and don’t fuss. He cannot jump above this threshold. Yes, I don’t require it anymore.

But how can a loved one not understand that he is hurting me with such an attitude and neglect. I can’t even sleep, this situation torments me so much. Some kind of mental immaturity? Misunderstanding of simple human things?

Why do you think this happens? If he had explained, I would have understood. But he doesn’t even want to explain anything. Why does he behave irresponsibly? We are adults after all. But all my words are like peas against a wall. Maybe I don't understand something?

A story from one of our editor's friends. She is 34, her husband is 37, and in their relationship they don’t live a day without any gags and jokes on each other. Where it all started

In the spring of 2017, my husband and I went to Egypt for 3 weeks. We planned to have a fun holiday, swim in the Red Sea, look at the pyramids, and buy a couple of souvenirs for friends and relatives. This is, if you like, a classic recreation program. We took a good double room in one of the four-star hotels in Hurghada. We didn’t really plan anything from the cultural program, except for a trip to the Pyramids of Giza. But fate decreed otherwise.

7 days have passed since checking into the hotel and Maxim (husband) is tired of, as he put it, “hanging around all day in this rotten hotel.” As a result, every day he bought various kinds of excursions from the guides assigned to the hotel. First it was diving. I’m afraid to dive myself, but he dived for 3 hours to look at the corals and fish. Beautiful, of course, but terribly expensive! The second time he took a camel excursion, a group of us rode through the desert with short stops to rest. Extraordinarily great! It was really interesting for me here - I liked the camels, and the views of the desert along with the sea are simply amazing during sunset. 2 days later, in the morning, my husband suggested that we go for a ride in the desert with the group again, but on ATVs. She agreed without hesitation.

I’m a little afraid of high speeds, extreme sports and other dangers, so I began to doubt myself and even thought about giving up the tour. But Maxim has already paid for everything, and the excursion starts in 4 hours. My husband laughed at me at first, but then he calmed me down by saying that we would be riding together on a two-seater ATV. After 5 hours we were already driving with a group through the desert. The group was led by two guides - the main one rode at the head of the column, and the assistant brought up the rear. It was very hot and pretty soon I was drenched in sweat, just like everyone else. After another hour, everyone was pretty tired, so the guide suggested that the whole group stop by the Bedouin camp. They say, there we will rest, drink water, and meet strange people. He assured that they knew each other well, so we would be welcomed there. I have no doubt that he had some additional interest from this.

We arrived at a Bedouin camp, and there... everything was like normal people, they just lived in tents. Water, electricity, microwaves, TVs - everything is. Children are running around, women are cooking. Everything is like in an ordinary Russian village, only there is desert around. That's the first thing I thought. And in vain, because the traditions here turned out to be completely wild!

When we were about to leave the Bedouin camp, the main guide approached my husband and asked Maxim if he would sell his wife for 40 camels. At the same time, I am standing next to my husband! Max turns to me and begins to laugh slyly, as he does when he has come up with some kind of witty joke, in his opinion. This time his joke was that he agreed to sell me. Very funny, yes. This idiot said to the guide through laughter “OK! Give 40 camels now” (editor’s translation: “Okay! Give me 40 camels here.”). I also started laughing myself. In 2017, giving your wife for camels is ridiculous. And I honestly thought that the guide just wanted to joke. It turned out not.

The guide went to his assistant, they discussed something in a raised voice for 10 minutes. Then the assistant guide got on the ATV and started shouting to the group to get everyone ready to go. Well, my husband and I also went to see our war horse. And then, in the best traditions of cinema, our guide grabs me by the hand and drags me towards one of the tents. Out of the corner of my eye I see that Maxim continues to walk towards the ATV. I panic, I start screaming and calling for help.

The husband came running in a moment and began hitting the guide with all his might. He has the same misunderstanding and horror in his eyes, just like mine did seconds ago. And then a crowd of camels is brought towards us. Silent scene. The meaning of what is happening reaches us, I begin to laugh hysterically, and my husband looks panicked in his eyes. He speaks English at the fifth grade level. He doesn’t understand how to clearly explain something here, but he’s clearly not going to give me up without a fight. What is going on in the heads of the guys on ATVs at this moment is a mystery to me.

It didn’t take long to explain to the guide that this was all a joke from my husband and that the deal wouldn’t last long. According to the guide, the local rich Bedouin really liked me and since he had already brought camels, the deal was done. We argued until my husband got tired of it all - he simply made an obscene gesture to the guide and dragged me by the hand to the ATV. I would prefer that he was carrying me in his arms at this moment. It's all his fault, after all. Upon arrival, I forced my joker to apologize to the guide and pay a good tip on top, otherwise the police would come to our hotel.

They are generally a very unusual couple; when traveling they constantly find themselves in idiotic situations and create incredible problems for themselves out of nowhere. But their stories are most interesting to listen to in company. When we have time, we will definitely ask the editor to visit this friend and record a few more for our site.
